Terms and Conditions

Thank you for choosing DJ Dan as your DJ / Audio Visual event entertainment.

This is an agreement under which you (hereafter ‘the client’, ‘you’ or ‘your’) agree to use the services (‘the terms’) supplied by DJ Dan (‘the firm‘). Please read these terms carefully before booking with me or using my services. The terms enclosed are important because they set out the rights and obligations of you as the client, details of your designated event, and the use of my services (‘your booking’).

By accessing and/or using the website, you accept these terms and agree to be bound by them, and an agreement is formed between you and I. If you do not accept these terms, you must refrain from using this website or making a purchase/booking from this website.

This contract is subject to change without notification to the buyer, I reserve the right to alter this contract at any time, E & OE.

1. Payments & Pricing

1) Payment will depend on service required, event details and event requirement.

2) In order to secure the event date and my services, full payment must be made prior to the event leaving sufficient time to organise running sheet / equipment and song requests.

3) If the distance to the venue is more than 25 kms from Melbourne CBD, additional travel time may be charged.

4) If your event is extended beyond 5 hours, an additional charge will apply.
Towards the planned end of the event, if you wish to extend, and an additional payment for the extra time is made, my services may be extended.

5) My services are usually up to 5 hours. The payment is tailored to a package for a specific event. (It is not an hourly rate).
It can be extended beyond 5 hours at my discretion either when booking or towards the conclusion of the event.

2. Cancellations / Rescheduling

1) Cancellations and/or reschedules (excluding COVID-related reschedules) are considered a change of mind, and refunds are subject to the firm’s discretion. This must be done in writing with a reason specified.

Cancellation fees are likely to be as follows. But are subject to change at any time at the firms discretion.
a. Cancellation within 7 days of Event: 100% of the entire event cost.
b. Cancellation within 14 days of Event: 50% of the entire event cost.
c. Cancellation longer than 14 days of Event: 10% of the entire event cost or $200, whichever is higher.

2) Rescheduling the length of the booking is permitted by the firm. The firm reserves the right to issue a new fee structure based on the length of the booking. Refunds will not be provided if the client chooses to end their event early.

3) Requesting to change booking times may incur additional fees due to conflicts with other event bookings and/or setup times.

4) Rescheduling of the date is subject to availability, and prices may change to reflect demand. Booking fees may be forfeited as you will be entering into a new contract with the firm. The firm reserves the right to issue a new invoice based on the date of the new booking (i.e., peak period vs off-peak). Rescheduling can not be done more then one time.

5) Refunds of the booking fee will be forfeited if the firm is not available on the date of a requested reschedule. The firm may allow the booking fee to be credited to an alternate event.

6) When rescheduling a booking, the client will be informed by the firm of availability on the dates suggested. If the client chooses a date the firm is not available, this constitutes a change of mind. This change of mind may result in the loss of any booking fees paid. Credits may be applied for future bookings.

3. Music Requests

1) The client is required to provide DJ Dan, a list of chosen music requests (by a Spotify collaborative playlist), no later than 14 days (two weeks) before the designated event. This gives me sufficient time prior to the event to organise the music accordingly.
The client can create the Spotify collaborative playlist request link at the booking stage and keep adding to it accordingly.

2) I generally use the playlist as a rough guide and play the majority of the playlist throughout the night at appropriate times. I also am happy to take requests from guests on the night (provided I can satisfy those requests from my large collection).

3) The streaming of Internet or YouTube songs, and the use of guest iPods / Phones and CDs on the night are strictly prohibited. YouTube is fairly low quality and may result in buffering issues (stop/start).

4. Hirer / Venue requirements

1) I require at least 1 x 10 amp power socket that is within 5m of where I am setup.
(Ideally this should be on a seperate power circuit from any other equipment in the venue to avoid power interference from other appliances. The power should be a stable/reliable power.)

2) I should be setup as close as possible to the dance floor location. (If the venue has a stage, I should be setup on that.)

3) I also require at least a 1.5m (or longer) trestle table with table cloth. Should the venue not have this, please let me know in advance.

4) If the function room is not on the ground floor of the venue please let me know in advance.
(Should there not be a lift to the floor or it is difficult to load in/load out my equipment to/from the venue, additional costs may apply.)

5) If it is an outdoor function, it is the clients responsibility that all equipment is well protected from the weather and that both the equipment and myself have adequate shading from the sun.

6) If you are booking my lighting/vision premium services, it is the responsibility of the client (or events manager) to send through a detailed venue floor plan detailing power points and any AV inputs (projector HDMI input / XLR 3 pin or RCA speaker inputs) etc.. This should be done asap after the booking is fully confirmed in order to organise all the required equipment.

7) If I am harassed under gross misconduct or verbally or physically abused in any way or my equipment is harmed in any way, I have the right to shut down the music if deemed unsafe. It is the clients responsibility that I am performing in a safe work place. No refunds will be given as a result of this.

8) I will not be held responsible for any circumstances or events outside my control. This includes, but is not limited to, power failure, venue’s equipment failure, natural disaster, fire, riot and accidents.

5. Promotional Material

1) By booking me for my DJ or other services you agree / give consent for me to take photography and videography of the event for promotional use.

6. Amendments and Variations

1) DJ Dan reserves the right to revise and update these Terms and Conditions by making any changes immediately without notifying you. I may revise these terms from time to time.
